1. Purpose
These general terms of use and sale (« Terms ») govern access to and use of the Briefetch service by any agency, studio, or freelancer (« User » or « Owner ») creating an account on the platform. They apply to the exclusion of any other terms. Access to a project via a magic link by a User's client does not require acceptance of these Terms; the User remains solely responsible for their relationship with their own clients.
2. Service publisher
Briefetch is published by Kenan Colombien, in his capacity as an affiliate of ASBL Productions Associées (Smart activities cooperative). See the legal notice for full identification.
3. Service description
Briefetch allows a User to create, for each project, a checklist of expected deliverables (files and/or text responses) and share it with their client via a unique magic link, without the client needing to create an account. Uploaded files are transferred directly to Cloudflare R2 storage via presigned URL. The User can follow up with their client via automated email or a manual WhatsApp open link.
4. Account and access
Owner account: created with email and password via Supabase Auth. The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account. Only one company may be linked to an Owner account.
Client access: no account, no password. Access is exclusively via a unique token (magic link), limited to the project in question and may expire or be revoked by the User at any time.
5. Pricing and billing
Briefetch offers a single plan at €19 excl. VAT per month, billed in 3-month or 12-month periods (no monthly billing). Applicable VAT is added according to the User's country.
Every new account receives a one-month free trial with no credit card required. At the end of the trial, if no payment is made, dashboard access is automatically suspended (see section 7); account data and files are retained and access is restored upon payment.
Payment is currently made by bank transfer on invoice; no automatic direct debit is in place at this time. The User is contacted directly to arrange payment for each billing period.
A limited number of « founding member » accounts receive lifetime free access, subject to fair use (capped at 3 GB of storage per project). Briefetch reserves the right to review this status in case of manifestly disproportionate use compared to normal agency usage.
6. Right of withdrawal
Briefetch is a service intended for professional users (agencies, studios, freelancers) acting in the course of their business: the 14-day consumer right of withdrawal does not apply. As a precaution, if a User were to be considered a consumer under applicable law, they acknowledge that immediate provision of the account and the one-month free trial constitutes full performance of the service at their express request, waiving this right from the start of the trial.
7. Suspension and termination
The User may stop using Briefetch and choose not to renew payment at any time: no commitment beyond the period already paid, and no pro-rata refund for a period already started. Upon expiry of a period without renewal, Owner dashboard access is suspended; magic links already shared with clients remain active so as not to interrupt an ongoing project.
An account may be deleted, with associated files purged, in case of prolonged inactivity in accordance with our privacy policy, or at the User's request from the Settings page.
8. Liability
Briefetch undertakes to provide the service with due care (best-efforts obligation) but does not guarantee uninterrupted availability. The publisher shall not be liable for interruptions due to force majeure or failure of its technical sub-processors (Supabase, Cloudflare R2, Resend, Vercel).
The User remains solely responsible for the content of the projects they create, the information they communicate to their clients, and compliance with their own legal obligations (including GDPR) towards their clients in the course of their own business.
9. Ownership of data and files
Files uploaded by clients and project content belong to the User (or to their own client, as agreed between them). Briefetch acts as a technical hosting and provision provider and claims no ownership rights over this content.
10. WhatsApp follow-up
The WhatsApp follow-up button opens a manual conversation (wa.me link) from the User's device. Briefetch does not use the WhatsApp Business / Meta API and does not process, store, or transmit any messages sent through it.
11. Data protection
Processing of personal data is detailed in our privacy policy, which forms an integral part of these Terms.
12. Changes to the Terms
Briefetch may update these Terms, in particular to reflect the addition of new features or payment terms. Users will be notified of any material change by email or dashboard notification. Continued use of the service after notification constitutes acceptance of the new terms.
13. Governing law and jurisdiction
These Terms are governed by Belgian law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of the Brussels judicial district, unless mandatory legal provision provides otherwise.
